1. Acceptance of Terms

By purchasing, installing, or using OctoGrab ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to use OctoGrab for personal or commercial purposes, subject to these Terms.

  • The license is for a single user (you may install on multiple devices you own)
  • You may not redistribute, resell, sublicense, or share your license key with others
  • You may not reverse engineer, decompile, or modify the Software
  • The license includes all future updates to the current major version

3. Acceptable Use

You agree to use OctoGrab responsibly and in compliance with all applicable laws. You must not use OctoGrab to:

  • Violate any website's Terms of Service or robots.txt directives
  • Scrape personal data in violation of GDPR, CCPA, or other privacy laws
  • Overload or disrupt any website's servers (denial of service)
  • Collect data for illegal purposes including fraud, spam, or harassment
  • Bypass authentication, paywalls, or access controls without authorization
  • Infringe on copyrights, trademarks, or intellectual property rights

You are solely responsible for ensuring that your use of OctoGrab complies with the terms of the websites you interact with and all applicable laws in your jurisdiction.

4. Disclaimer of Warranty

OctoGrab is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • That the Software will be error-free or uninterrupted
  • That the Software will be compatible with all websites
  • That extracted data will be accurate or complete

Websites frequently change their structure, which may cause blueprints to stop working. This is inherent to web scraping and is not considered a defect.

5. Limitation of Liability

To the maximum extent permitted by applicable law, OctoGrab and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Damages arising from your use of extracted data
  • Damages arising from website terms violations
  • Any claims by third parties

Our total liability shall not exceed the amount you paid for the Software.

6. Payment and Pricing

  • The current price is a one-time payment for lifetime access
  • Prices may change at any time; existing customers are not affected
  • All prices are in USD unless otherwise stated
  • Payments are processed securely by Stripe
  • Refunds are subject to our Refund Policy

7. Intellectual Property

OctoGrab, including its code, design, logo, and documentation, is the intellectual property of its creator. All rights not expressly granted in these Terms are reserved.

Blueprints you create and data you extract belong to you. We claim no ownership over your content.

8. Updates and Changes

We may release updates to OctoGrab at our discretion. While we strive to maintain backward compatibility, we cannot guarantee that all blueprints will continue to work identically after updates.

We reserve the right to modify these Terms at any time. Material changes will be communicated via our website. Continued use after changes constitutes acceptance.

9. Termination

We may terminate your license if you violate these Terms, specifically:

  • Sharing or redistributing your license key
  • Using OctoGrab for illegal purposes
  • Attempting to circumvent licensing mechanisms

Upon termination, you must cease using OctoGrab and destroy all copies.

10. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation first.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
